Kongka Furniture – Terms of Service
Effective date: 27 January 2026
This website (the “Website”) is operated by Kongka Manufacturer Company Limited (trading as “Kongka Furniture”, “Kongka”, “we”, “us”, or “our”) in Thailand.
These Terms of Service (“Terms”) apply to www.kongkafurniture.com and any related Kongka Furniture / Kongka Manufacturer webpages, checkout pages, and customer service channels that reference these Terms.
By accessing or using the Website, creating an account, requesting a quotation, placing an order, or purchasing any product, you agree to be bound by these Terms and our Privacy Policy (together, the “Agreement”). If you do not agree, you must not use the Website or place an order.
Language: English is the controlling version of these Terms. A Thai version may be provided later for convenience; if there is any conflict, the English version prevails.

2) Definitions
-
“Customer” / “you” means any person or entity using the Website or purchasing Products.
-
“Consumer” means a Customer purchasing mainly for personal use. “Business Customer” means a Customer purchasing for business/commercial purposes. These Terms apply to both Consumers and Business Customers.

“Products” means furniture and related goods sold by Kongka.

“Stock Items” means Products available for dispatch without custom production.
-
“Made-to-Order / Bespoke” means Products manufactured or customized to your specifications.
-
“Working Day” means Monday–Friday excluding Thai public holidays.
-
“Own Logistics” means delivery performed by Kongka or Kongka’s in-house team.
-
“Third-Party Carrier” means a delivery provider not operated by Kongka (courier/freight/forwarder).
3) Eligibility
By placing an order you confirm that:

you are at least 18 years old (or have legal capacity to contract), and
-
the information you provide is complete and accurate.
4) Website Use and Account Registration
Kongka Furniture provides a curated selection of our Products for viewing and purchase.
Some Website features may require account registration. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You agree to notify us immediately if you suspect unauthorized access.
5) Quotations, Orders, and Contract Formation
5.1 Quotations
Where we provide a quotation, it may include drawings, dimensions, materials, finishes, lead times, delivery terms, and pricing. Unless stated otherwise, quotations are valid for the period stated in the quotation.
5.2 Acceptance and “Signed Quotation” (including electronic acceptance)
A Signed Quotation with drawing approval may be completed by:

a physical signature; or
-
an electronic signature or electronic confirmation via email or social/chat applications (including but not limited to LINE or WhatsApp) that clearly indicates approval/acceptance of the quotation and drawings.
5.3 Order Acknowledgment vs. Binding Contract

Order acknowledgment / confirmation email confirms receipt only and is not final acceptance.

A binding contract is formed only when we send either:
-
a Dispatch Confirmation (for Stock Items), or
-
a Production Commencement Notice (for Made-to-Order / Bespoke).

5.4 Our Right to Refuse or Cancel
We may refuse or cancel an order (before contract formation or, where permitted by law, after) due to technical errors, mispricing, suspected fraud, payment verification issues, or unforeseen material availability issues. If we cancel an order after receiving payment for the cancelled portion, we will notify you and refund the amounts paid for that cancelled portion.
6) Pricing, Currency, Taxes, and Payment
6.1 Currency and Taxes
Prices are primarily displayed in Thai Baht (THB). Unless stated otherwise, prices may or may not include applicable Thai VAT (where applicable).
6.2 Payment Methods
Payments may be processed through third-party providers such as Stripe, PayPal, Beams (or similar services), and we may also accept wire/bank transfer. Your payment may be subject to the provider’s terms and verification checks.
6.3 Deposits and Payment Timing
Made-to-Order / Bespoke

A 50% deposit is required before production begins.
-
The remaining 50% balance is due before or at delivery, and must be fully paid before the Product is released to you.
Stock Items
-
We may request a 30% deposit for some offline/manual stock orders.
-
For Website checkout purchases, we may charge the full amount upfront.
6.4 Authorization and Verification
Payment must be authorized/verified and cleared before production or dispatch begins. We are not responsible for delays caused by payment verification, bank processing times, or compliance checks.
6.5 Pricing Errors
If a Product is displayed with an incorrect price or incorrect information, we may correct the error. If the error affects your order, we may cancel and refund amounts paid, or contact you to reconfirm at the corrected price before dispatch or before production commences.
7) International Orders and Required Consultation
For customers located outside Thailand:

Mandatory Tax & Delivery Consultation: Before completing a purchase (or as soon as possible after checkout), you are required to contact us at Kuladej@kongkafurniture.com** or any related channel from Kongka Furniture for a tax and delivery consultation. We may pause or cancel an order if consultation is required and has not been completed.**

Import Compliance: You are responsible for ensuring the Products comply with all import laws and standards in the destination country.

Duties and Taxes: Unless otherwise agreed in writing during consultation, you are responsible for customs duties, import taxes, brokerage fees, and any other charges imposed by authorities in the destination country.

Customs Holds/Refusals: If customs authorities reject, hold, seize, or require additional documentation/fees, you are responsible for resulting costs (including storage, re-delivery, return shipment, or destruction where applicable). We will provide reasonable support, but such events are outside our control.
8) Product Quality and Artisanal Nature
As a direct manufacturer, Kongka maintains rigorous quality standards.

Natural materials: Wood and mother-of-pearl/shell are natural materials. Variations in grain, color, shade, pattern, and texture are inherent characteristics and are not considered defects.

Handcrafted finish: Slight variations between digital images (including website photos) and the physical Product may occur due to lighting, screen settings, and artisanal manufacturing processes.

Measurements: Minor measurement tolerances may occur in artisanal production.
9) Delivery, Installation, Delivery Proof, and Risk
9.1 Typical Lead Times
-
Stock Items: typically 5–7 Working Days including packing (before dispatch), subject to availability and scheduling.
-
Made-to-Order / Bespoke: typically ~4 months manufacturing plus 5–7 Working Days delivery after completion.
Where installation or site conditions require additional work (e.g., difficult access, building restrictions), timelines may vary and will be agreed case-by-case.
9.2 White-Glove Delivery and Installation (Thailand)
We may offer white-glove delivery and/or installation within Thailand. Fees (if any) are determined case-by-case and will be communicated and approved before service.
9.3 Signature Requirement and “Delivery” Definition
A signature is required as proof of delivery.
Own Logistics (Kongka delivery team):
-
“Delivered” means the Customer (or authorized recipient) signs the delivery order/form at the delivery address.
Third-Party Carrier (rare; courier/freight/forwarder):
-
“Delivered” for shipment purposes means the Third-Party Carrier signs the receiving document when taking possession from Kongka (handover to carrier).
9.4 Risk Transfer
Risk transfers only when the relevant delivery handover occurs and full payment has been made.

Own Logistics: Risk transfers to you when (i) you sign the delivery order/form at the address and (ii) full payment has been made.

Third-Party Carrier (rare): Risk transfers to you when (i) the carrier signs the receiving document/takes possession from Kongka and (ii) full payment has been made. For avoidance of doubt, if a Third-Party Carrier is used, we may require full payment before we hand the shipment to the carrier.
9.5 Access, Redelivery, and Incorrect Information
You must ensure safe access and suitable conditions for delivery and installation (including elevators, door widths, parking, and building restrictions). If items are undeliverable due to incorrect details, lack of access, or refusal to accept delivery, you may be liable for storage, return-to-sender, re-delivery, or additional handling fees.
10) Inspection, Damage Reporting, and Claims
10.1 Visible Transit Damage (48 hours)
You must inspect Products promptly upon arrival. Any visible transit damage must be reported within 48 hours of delivery, with clear photographic evidence and order details.
10.2 Concealed Damage / Manufacturing Issues (30 days)
If you discover concealed damage or believe there is a manufacturing defect, you must notify us within 30 days of delivery, with photos/videos and a description of the issue.
10.3 Remedies (Case-by-Case; Repairment is only for customer in Thailand)
If a claim is confirmed, we may (at our discretion and subject to applicable law) provide one or more of the following remedies:
-
repair (preferred for local/Thailand customers where feasible),
-
replacement (in whole or part),
-
partial refund, or
-
other reasonable resolution case-by-case (especially for international orders).
11) Cancellations by Customer
11.1 Stock Items
You may request cancellation before dispatch. If dispatch has occurred, the request will be handled under the Returns section (Section 12), if eligible.
11.2 Made-to-Order / Bespoke

Before production commences: you may request cancellation by written notice.
-
Production commences when the 50% deposit is received (unless we agree otherwise in writing).
-
After production commences: Made-to-Order/Bespoke items are non-cancellable, non-returnable, and non-refundable, except where required by applicable law or where we agree in writing.
12) Returns and Refunds (Non-Custom / Stock Items)
12.1 Return Window and Condition
Eligible Stock Items may be returned within 30 days of receipt if:
-
unused, in pristine condition, and
-
returned with original packaging and accessories (where applicable).
12.2 Return Logistics and Costs
-
Within Thailand: We generally cover return shipping for eligible non-defective returns, but this may be handled case-by-case depending on circumstances (e.g., packaging condition, access, special handling requirements).

Outside Thailand: Customers are generally responsible for return shipping, duties, and related costs unless we agree otherwise in writing.
12.3 Restocking / Handling Fees
Restocking, re-packaging, pickup, or handling fees may apply case-by-case. If applicable, we will communicate the fee basis before finalizing the return.
12.4 Exclusions
Made-to-Order/Bespoke Products are not eligible for return or refund once production has commenced (Section 11.2).
13) After-Sales Support (No Fixed Warranty Period)
We do not currently offer a fixed warranty period on the Website.
However, we aim to support customers for the product’s lifespan via after-sales service. After-sales support may be free or chargeable depending on the issue, location, materials, and cause.
After-sales support does not cover issues arising from:
-
misuse or improper handling,
-
outdoor exposure,
-
humidity/warping beyond normal material movement,
-
normal wear and tear,
-
improper cleaning products/chemicals,
-
accidents,
-
unauthorized modifications or repairs.
Natural variations in wood and mother-of-pearl/shell are not defects (Section 8).
14) Retention of Title (Ownership)
Title/ownership of Products remains with Kongka until we receive full payment (including delivery/installation charges, if any) in cleared funds.
If you fail to pay any amount due, we may (where permitted by law) withhold delivery, suspend services, and/or request return of Products that have not been fully paid.
15) Intellectual Property
All content on this Website—including furniture designs, logos, photography, images, text, and Website design—is the exclusive property of Kongka or its licensors and is protected by Thai and international intellectual property laws.
You may not use, copy, reproduce, modify, or distribute our content or designs without prior written permission.
16) Prohibited Activities
You agree not to:
-
use the Website for fraudulent, illegal, or misleading activities,
-
attempt to gain unauthorized access to our systems,
-
post false, inaccurate, or deceptive information,
-
violate intellectual property rights of Kongka or any third party.
17) Privacy and PDPA (Thailand)
Kongka is committed to protecting user data in accordance with Thailand’s Personal Data Protection Act (PDPA) and our Privacy Policy.
We may use third-party providers to operate our services (for example: Shopify, payment processors, couriers, ERP systems, marketing/analytics tools, advertising platforms such as Meta/Google, and messaging channels such as LINE/WhatsApp where used for customer communication). Some providers may process data outside Thailand.
Your rights and our detailed practices (data categories, purposes, retention, and sharing) are described in our Privacy Policy.
18) Limitation of Liability
To the maximum extent permitted by applicable law:

Kongka is not liable for indirect, incidental, special, or consequential damages (including loss of profit, business interruption, or loss of goodwill) arising from use of the Website or Products.

Kongka’s total liability for any claim relating to a Product will not exceed the amount you paid for that Product.
However: Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law, including (where applicable) liability for fraud, wilful misconduct, death/personal injury caused by negligence, or statutory consumer/product liability rights.
19) Force Majeure
We are not responsible for delays or failures caused by events beyond our reasonable control, including supply disruption, natural disasters, strikes, war, government actions, or carrier delays.
20) Termination
We reserve the right to suspend or terminate access to the Website if we reasonably believe you have violated these Terms or applicable law.
21) Changes to These Terms
We may update these Terms from time to time. Updated Terms will be posted on the Website with a new effective date.
Changes apply prospectively and do not affect orders already accepted (i.e., where a binding contract has formed under Section 5.3), unless required by law.
22) Governing Law and Dispute Resolution
These Terms are governed by the laws of Thailand.
The parties will first attempt to resolve disputes through good-faith negotiation. If unresolved, disputes will be submitted to the jurisdiction of the competent courts of Thailand.
23) General Terms
23.1 Severability
If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force.
23.2 No Waiver
Our failure to enforce any right or provision does not waive that right or provision.
23.3 Assignment
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations under these Terms as part of a business transfer or reorganization.
23.4 Entire Agreement
These Terms and the Privacy Policy constitute the entire agreement between you and Kongka regarding the Website and Products and supersede prior communications on the same subject.
23.5 Electronic Communications
You agree that communications from us may be provided electronically (including email, Website notices, and messages through chat/social applications used for order confirmations).
